Terms of Service

1. Acceptance

These Terms are an agreement between you and switchboard-ai.com, the operator of Switchboard. By accessing or using Switchboard, you agree to these Terms. If you use Switchboard on behalf of a company, you represent that you have authority to bind that company.

Switchboard is a business service not directed to individuals under 18; we do not knowingly collect personal data from children. You must be at least 18 years old to create an account.

2. Service Description

Switchboard provides AI-powered customer operations tools including omnichannel messaging, AI workflow orchestration, and a unified company brain. Services are provided “as is” with commercially reasonable uptime.

3. Accounts & Billing

• You are responsible for maintaining account security
• Subscriptions are billed monthly or annually via Stripe
• Cancellations take effect at the end of the current billing period
• Refunds are not provided for partial periods
• We reserve the right to suspend accounts for non-payment after a 7-day grace period

4. Acceptable Use

You must not use Switchboard to:

• Process data you don't have rights to process
• Violate applicable laws or regulations
• Attempt to reverse engineer or extract our AI models
• Resell or white-label the service without a separate agreement

5. Data Ownership

You own your data. We process it only as instructed. We do not use your business data to train AI models without explicit consent. Upon cancellation, you may export your data within 30 days.

6. Limitation of Liability & Disclaimers

Switchboard AI outputs (conversations, document analysis, automated workflow execution) are provided for operational assistance and should not replace professional financial, legal, or medical advice. Services are provided “as is” without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, in no event shall Switchboard or its suppliers be liable for any indirect, punitive, incidental, special, or consequential damages. Our total aggregate liability under these Terms is strictly limited to the fees paid by you in the preceding three (3) months.

7. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to conflict of law provisions.

8. Dispute Resolution

Before starting any proceeding, you agree to contact us at ram@switchboard-ai.com so we can try to resolve the dispute informally. Any dispute arising out of or relating to these Terms that is not resolved informally shall be submitted to the courts of competent jurisdiction in Canada. Nothing in these Terms limits any statutory consumer rights that cannot be waived under applicable law.

9. Changes to Terms

We may update these Terms with 30 days' notice for material changes. Continued use after notice constitutes acceptance.
